Omada Property Group were referred to the client by Westpac Bank, the project financier after the client experienced significant difficulties with the appointed project builder. The client was inexperienced in property development and the construction contract heavily favoured the builder with onerous conditions and significant risk placed on the developer. The contract became unworkable and the project stalled after significant cost overruns during the demolition phase.
Omada was appointed project manager to get the project back on track and after reviewing the project documents, Omada entered into numerous negotiations and discussions with the project builder. Omada was able to negotiate a new D&C Contract between the client and the builder to the satisfaction of all parties, including the financier.
